1. Acceptance of Terms
By accessing DisciplineMastery.com, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws. If you do not agree, discontinue use immediately. These Terms constitute a binding agreement under New York General Obligations Law.
2. Service Description
We provide digital content, coaching sessions, and downloadable resources aimed at personal discipline improvement. Services are for personal development only and do not constitute psychological or medical advice. We disclaim any warranties of fitness for a particular purpose under UCC Article 2.
3. User Conduct
Users shall not: (a) attempt to gain unauthorized access to our systems (CFAA violations), (b) scrape content via bots, (c) infringe intellectual property, (d) submit false testimonials. Violators may be banned and prosecuted.
4. Payment Terms
Fees are stated in USD and due at purchase. Subscription services auto-renew unless canceled 48 hours prior. Refunds follow our Fair Refund Policy: cancellations within 7 days receive full refund less 5% processing fee. Late payments incur 1.5% monthly interest under NY CPLR 5004.
5. Intellectual Property
All materials (including frameworks, worksheets, and videos) are © Discipline Mastery LLC. Users receive a non-exclusive, non-transferable license for personal use. Commercial use, redistribution, or derivative works require written consent.
6. Limitation of Liability
To the maximum extent permitted by law, our liability for any claim is limited to the fees you paid in the prior 12 months. We are not liable for consequential damages, lost profits, or productivity outcomes. This clause survives termination.
7. Termination
We may terminate access for material breach (30-day cure period for non-legal violations). Upon termination, you must destroy all materials. Provisions Sections 4-8 survive.
8. Governing Law & Disputes
These Terms are governed by New York State law. Disputes shall be resolved via binding arbitration under AAA Commercial Rules, with venue in Manhattan, NY. Class action waiver applies under AT&T Mobility v. Concepcion.
9. Severability & Entirety
Invalid provisions shall be severed. These Terms supersede all prior agreements. Modifications require written agreement. Waivers are not retroactive.
